How we collect, use, and protect your personal information.
Distributed Industries Ltd. ("we," "us," or "our") owns and operates the PerfectMakeApp mobile application (the "App").
This policy describes:
- how we collect, use, disclose, protect, and otherwise process the personal information of our app users ("you");
- the types of personal information we may collect from you or that you may provide when you use our App and the services available through the App ("Services"); and
- our practices for collecting, using, maintaining, protecting, disclosing, and transferring that personal information.
Scope of Policy
This policy applies to our collection, use and disclosure of "personal information," which is any information about an identifiable individual. It includes information that can be used on its own or with other information to identify, contact, or locate an individual person. The policy does not impose any limits on the collection, use or disclosure of business contact information or certain publicly available information.
Accountability
We have designated a Privacy Officer who is responsible for our compliance with this policy. The Privacy Officer may be contacted as described in the "Contact Us" section below.
Acceptance of Terms
By using our App or Services, or otherwise by choosing to provide your personal information to us, you acknowledge and consent to the processing of your personal information in accordance with this policy, and as may be further identified to you when the personal information is collected.
If you do not consent to the processing of your personal information in accordance with this policy, please do not access or continue to use the App or Services or otherwise provide any personal information to us.
Changes to This Policy
We may update this policy from time to time to ensure ongoing compliance with applicable laws and for any other purpose that we deem reasonably necessary, all without prior notice to you, and any changes will be effective immediately upon the posting of the revised policy. We therefore recommend that you review it frequently. You can tell if the policy has changed by checking the effective date that appears at the top of this policy.
Where required by applicable law, we may need to ask you to confirm your consent to the processing of your personal information. Otherwise, your continued access to or use of our App and Services constitutes your acknowledgment and acceptance of the changes.
Children's Privacy
We do not knowingly collect personal information from children under 13. If we learn we have collected such information, we will promptly delete it. If you believe a child under 13 has provided us with personal information, please contact us at hi@perfectmakeapp.com.
PerfectMakeApp's Technology
PerfectMakeApp develops and provides software technologies for the cosmetics and beauty industry. PerfectMakeApp's technologies are used and made available in the service stated below:
Skin Colorimetry Analysis: PerfectMakeApp offers a skin colorimetry analysis software solution that assesses a user's facial images and other inputs (which may include the user's declared skin type, skin concerns, makeup preferences, or other information) and outputs data and content, including skin features, tone and undertone analysis, and personalized makeup recommendations.
How Your Selfie Is Handled
This is important, so we want to be completely clear:
Your selfie is captured and processed entirely on your device using face detection technology. The App extracts only abstract color values from specific facial regions.
Your photo is never uploaded to our servers, never stored in our database, and never shared with any third party.
The extracted color values are simple numerical codes that represent skin tone and feature colors. They cannot be used to reconstruct your face, identify you, or derive any biometric information. These color codes are the only data from your selfie that ever leaves your device.
Information We Collect
Account Information (Optional)
You can use the App fully without creating an account. If you choose to create an account, we collect your email address and an encrypted password. Anonymous usage is fully supported — no personal information is required to receive makeup recommendations.
Beauty Preferences
When you create a look, we collect your questionnaire responses, including skin type, skin concerns, makeup preferences, budget range, climate, and occasion. You provide this information voluntarily.
Color Data
The App extracts abstract color values from your selfie using on-device processing. These are numerical representations of skin tone and feature colors — not images. See "How Your Selfie Is Handled" above for full details.
Purchase Information
If you make in-app purchases, we receive transaction identifiers, purchase dates, and any promo codes used. Payment processing is handled entirely by Apple through its in-app purchase system — we never receive or store your payment card details.
Automatically Collected Information
We collect basic usage data through Firebase Analytics, including device type, operating system version, app version, and general interaction data. We do not use third-party advertising or tracking SDKs.
Analytics Tools
We may use automated devices and applications to evaluate usage of our App. We also may use other analytic means to evaluate our services. We use these tools to help us improve our services, performance, and user experiences. These entities may use cookies and other tracking technologies to perform their services. These technologies include Google Analytics. You can learn more about how Google uses the information collected through this service at www.google.com/policies/privacy/partners/.
How We Use Your Information
When collecting personal information, we will state the purpose of collection and will provide, on request, contact information for the Privacy Officer who can answer questions about the collection.
We collect, use, disclose, and process your personal information for the following purposes:
- to operate, maintain, administer, and provide to you the services, features, and functionality of the App and Services;
- to provide you with information, products, or services that you request from us;
- to verify and authenticate your identity as needed when you use or interact with certain services or functions for which you have an account or login;
- to ensure that the App and Services are optimized for your use and benefit;
- to analyze user experience and improve our App and Services;
- to communicate with you to provide you services, contacts, materials, and/or recommendations for your needs as identified by you through the App or email;
- to carry out our obligations and enforce our rights arising from any contracts with you, including for billing and collection or to comply with legal requirements;
- to notify you about changes to our App or Services or any products or services we offer or provide through them;
- to comply with internal policies and procedures and other legal, accounting, or security requirements;
- to provide personal information to third-party suppliers of products and services (as discussed in more detail below);
- to manage or transfer our assets or liabilities, for example, in the case of an acquisition or merger, the provision of security for a credit facility, or the change of a supplier of products or services;
- to protect us, yourself, and others from fraud and error, to safeguard our business interests, and to protect the rights, property, or safety of us, our customers, or others;
- to collect debts owed to us;
- to comply with legal and regulatory requirements and to comply with any court order, law, or legal process, including to respond to any government or regulatory request, in accordance with applicable law;
- to distribute to third parties including financial institutions, payment processors, and government licensing bodies for any of the above purposes; and
- for any other reasonable purpose that we may describe when you provide the information.
The collections, uses, and disclosures listed above are a reasonably necessary part of your relationship with us. We may also use your information to contact you about our own and third-parties' goods and services that may be of interest to you, as permitted by law. You may opt out of any such communications at any time.
Under applicable state privacy laws, you may have rights including the right to access, correct, delete, and obtain a copy of your personal information, and in certain states the right to opt out of the sale or sharing of your personal information.
If your personal information is to be used for a purpose not previously identified, we will disclose the new purpose to you before that use, and we will seek your consent unless the use is authorized or required by law.
Consent
We will obtain your consent to collect, use, or disclose personal information except where we are authorized or required by law to do so without consent. Your consent can be expressed, implied, or given through an authorized representative such as a lawyer or agent.
Consent may be provided orally, in writing, electronically, through inaction (such as when you receive notice that your information will be collected, used, or disclosed for various purposes, and you do not notify us that you do not want your information processed for those purposes), or otherwise.
Where you have provided your consent to the collection, use, and disclosure, or other processing of your personal information, you may have the legal right to withdraw that consent under certain circumstances, provided that you give us reasonable notice. To withdraw your consent, contact us at hi@perfectmakeapp.com. If you withdraw consent, we will inform you of the likely consequences, which may include our inability to provide certain services for which that information is necessary.
Limits on Collection, Use, Disclosure, and Retention
We will not collect personal information indiscriminately, but will limit collection of personal information to that which is reasonable and necessary for the identified purposes. We will also collect personal information as required or authorized by law.
We will only use or disclose your personal information for the purposes set out above and as required or authorized by law.
We retain your personal information (including extracted color data and beauty preferences) for as long as your account remains active. When you delete your account or request deletion of your information, we will permanently erase all such data within 45 days of your request.
We will destroy, erase, or make anonymous records containing personal information as soon as it is reasonable to assume that the original purpose is no longer being served by retention of the information and retention is no longer necessary for a legal or business purpose.
Under some circumstances we may anonymize your personal information so that it can no longer be associated with you. We reserve the right to use such anonymous and de-identified data for any legitimate business purpose without further notice to you or your consent.
Disclosure and Transfer
We may disclose or transfer your personal information for the purposes set out above in the following ways:
- to our employees and personnel;
- to our affiliates and business partners;
- to our contractors, agents, service providers, and other third parties we use to support our business, and who are obligated to keep personal information confidential, use it only for the purposes for which we disclose it to them, and to process the personal information with the same standards set out in this policy. These service providers may include, without limitation:
- hosting and infrastructure providers (e.g., Rackspace, DigitalOcean, Firebase, Amazon Web Services, Microsoft Azure, Google Cloud Platform);
- artificial intelligence and machine-learning providers (e.g., OpenAI, Anthropic, Google AI, Microsoft Azure AI, Amazon SageMaker);
- analytics and performance monitoring services (e.g., Google Analytics, Mixpanel, Datadog);
- customer support and communication platforms (e.g., Zendesk, Intercom, Twilio);
- payment processors and billing services (e.g., Stripe, PayPal, Braintree);
- to law enforcement, government or regulatory bodies, or other lawful authorities as required or permitted by applicable law; and
- in accordance with applicable law, to a buyer or other successor if there is a merger, divestiture, restructuring, reorganization, dissolution, or other sale or transfer of some or all of our business or assets.
We do not sell or share your personal information. California residents may submit privacy requests via hi@perfectmakeapp.com.
International Data Transfer
PerfectMakeApp servers are based in the United States of America. Our affiliates, service providers, and other parties to whom we transfer personal information as described above may be located outside of your home jurisdiction within the US, or outside the US. You acknowledge that personal information may be processed and stored in foreign jurisdictions with different privacy laws, and that the governments, courts, or law enforcement or regulatory agencies in those jurisdictions may be able to access that personal information through the laws of the foreign jurisdiction.
Third-Party Services
Google Firebase (Google LLC)
We use Firebase for authentication, database storage (Firestore), cloud functions, file storage, and analytics. Your data is processed and stored in the United States. Firebase's privacy policy: https://firebase.google.com/support/privacy
Google Gemini API (Google LLC)
Our AI recommendations are powered by Google's Gemini API. The Gemini API receives only your abstract color codes and beauty preferences to generate makeup recommendations. It does not receive your photos, email address, or any personal identifiers. Google's AI terms: https://ai.google.dev/terms
Apple
In-app purchase receipts are validated through Apple's servers. This process is subject to Apple's privacy policy.
We do not sell your data to any third party. We do not use any third-party advertising or tracking services.
Data Storage and Security
We use reasonable physical, electronic, and organizational measures designed to secure your personal information from accidental loss and from unauthorized access, collection, use, disclosure, copying, modification, disposal, or similar risks.
Your data is stored on Google Cloud infrastructure (Firebase) in the United States. We protect your data using:
- HTTPS encryption for all data transmitted between your device and our servers
- Firebase Authentication for secure access control
- Firestore security rules to restrict data access to authorized users
We will take reasonable measures, through contractual or other reasonable means, to ensure that a comparable level of personal information protection is implemented by our service providers and agents who assist in providing services.
The safety and security of your information may also depend on you — for example, if you have a password for access to certain parts of the App or Services, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.
While we implement commercially reasonable security measures, no method of electronic storage or transmission over the Internet is completely secure, and we cannot guarantee the absolute security of your personal information. You should always exercise caution when disclosing personal information over the Internet.
Accuracy and Correction
We will make a reasonable effort to ensure that personal information we are using or disclosing is accurate and complete. If you provide the information, we will rely on you to make sure it is correct.
If you demonstrate the inaccuracy or incompleteness of your personal information in our custody or control, we will update the information as required. If appropriate, we will send the amended information to third parties to whom the information has been disclosed.
If we do not resolve a challenge regarding the accuracy of your personal information to your satisfaction, we will annotate the personal information under our control to indicate that the correction was requested but not made.
Accessing and Correcting Your Information
You have a right to access and correct your personal information that we hold.
Upon your written request and authentication of identity, we will provide you with your personal information under our control. We will also give you information about the ways in which that information is being used and a description of the individuals and organizations to whom that information has been transferred or disclosed. We may charge you a reasonable fee for doing so.
In some situations, we may not be able to provide access to personal information. If we cannot provide you with access to your personal information, we will inform you of the reasons why, subject to any legal or regulatory restrictions.
To access or correct your personal information, please email hi@perfectmakeapp.com. We will respond within 45 days of receiving your request, with one possible 45-day extension if necessary.
Your Rights
You have the right to:
- Use the App anonymously without providing any personal information
- Access, correct, or request deletion of your data at any time
- Revoke camera permission at any time through your device settings
- Opt out of analytics collection through your device settings
- Withdraw your consent to the processing of your personal information
- Contact us with any questions or requests regarding your data
